Background and Context:



Following a recent inspection by the Dubai Land Department (DLD), several significant compliance violations were identified within the common areas of Marina View Towers. These violations, outlined below, necessitate immediate legal action to ensure remediation and compliance with local laws. A legal notice has already been sent to the violating parties, mandating rectification and regulatory approval within 30 days.
The specific violations include:
- Unauthorized food preparations.
- Improper food storage.
- Use of food freezers.
- Installation and operation of restaurant exhaust systems within the parking area, resulting in pervasive cooking smoke.
- Unregulated stacking of kitchenware throughout the parking basements.
- Improper installation of fresh water tank systems on basement walls for kitchen use.
- Utilization of storage areas without proper title deeds or legal documentation for operations.
The notice required the violating parties to secure the necessary approvals from:

Building Management of Marina View Towers


Failure to comply within the stipulated timeframe will necessitate court action to enforce compliance and mitigate potential liability for the Owners Committee and Ittihad Community Management.

Objective:



We seek legal services to represent Marina View Towers and the Owners Committee in filing a case with the appropriate court to enforce compliance and seek legal remedies. This action aims to:
Ensure the cessation of unauthorized activities. Compel the violators to remediate violations and secure necessary approvals. Protect the Owners Committee and Ittihad Community Management from counterclaims or legal liabilities.

Scope of Work:

Case Preparation and Filing:



Review all relevant documentation, including the legal notice, inspection report, and responses (if any) from the violators. Prepare all necessary legal documentation to file the case with the relevant court in Dubai.-

Representation and Advocacy:



Represent Marina View Towers and the Owners Committee in all court proceedings, including preliminary hearings, mediation sessions, and trial (if necessary).-

Legal Strategy and Guidance:



Provide expert advice on the best legal strategy to achieve the desired outcomes while minimizing risks. Ensure compliance with all relevant laws and regulations in the UAE.-

Coordination with Authorities:



Liaise with relevant regulatory bodies, including the Dubai Land Department and Dubai Municipality, to support the case.-

Updates and Reporting:



Provide regular updates on the progress of the case. Submit detailed reports on actions taken, court proceedings, and outcomes.

Deliverables:



- Draft and file the legal case within [Specify Timeline].
- Representation in all court proceedings until case resolution.
- Periodic progress reports.
- Final report summarizing the case outcome and any follow-up actions.

Submission Requirements:

Conflict of Interest



The Supplier certifies that to the best of his knowledge and belief no economic, beneficial, or managerial relationship exists between the Supplier and any employee of Itihad Community Management (ICM) or between Supplier and any relative of an employee of ICM or any of its agents, which would tend in any way to influence such employee in performance of his or her duties on behalf of ICM or its agents in connection with the awarding, making, amending, or making a determination concerning performance of its proposal the work or the agreement.
Exchanges or offering of any money, gift item, personal service, entertainment or unusual hospitality by the Supplier to the employees or agents is expressly prohibited. This prohibition is equally applicable to officers, employees, or immediate family members of ICM’s agents. Any violation of this provision constitutes a material breach of ICM’s terms of agreements.
ICM may by written notice to the Supplier disqualify and reject the Supplier’s proposal and terminate the agreement without any liability whatsoever on part of ICM or any of its agents if finding (a) that vendor violated the certification contained in this declaration regarding conflict of interest; or (b) that gratuities were offered or given by the Supplier or any of its employees , agents or representatives, to any officers or employees of ICM or its agents awarding making and/or amending an RFP document or agreement or securing favorable treatment with respect to the performance of such agreement.
